TERMS AND CONDITIONS OF SERVICE

Welcome to Austin Karaoke, located in Austin, Texas. By making a reservation, accessing our premises, or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before submitting your reservation request.

1. DEFINITIONS

"Austin Karaoke," "we," "us," or "our" refers to Austin Karaoke and its owners, operators, employees, agents, and representatives.

"Customer," "you," or "your" refers to the individual making a reservation and/or using our services, including all members of their party.

"Premises" refers to the Austin Karaoke venue and all areas accessible to customers.

"Services" refers to karaoke room rentals, equipment use, food and beverage service, and any other services provided by Austin Karaoke.

2. RESERVATIONS

2.1 Reservation Requests

All reservations are subject to availability. Submitting a reservation request does not guarantee confirmation. A reservation is not confirmed until you receive confirmation from Austin Karaoke via email, text message, or verbal confirmation over the phone.

2.2 Reservation Modifications and Cancellations

Requests to modify your reservation (including date, time, party size, or room type) must be made at least 48 hours prior to your scheduled reservation time. Modifications are subject to availability and our approval. Cancellations or modifications made less than 48 hours before your scheduled reservation time may result in a cancellation fee ranging from 50% to 100% of the reservation cost, as described in Section 5.

2.3 Age Requirements

Austin Karaoke is an all-ages venue. Guests of all ages are welcome. However, customers must be at least 18 years of age to make a reservation and accept these Terms and Conditions. The reservation holder assumes full responsibility for all members of their party, including any minors. Please note that while minors are welcome at our venue, our BYOB policy (Section 6) prohibits the possession or consumption of alcohol by anyone under 21 years of age.

3. PAYMENT TERMS

3.1 Payment Methods

Full payment for services is due at the time of service and will be collected in person at our venue. We accept cash, debit cards, and major credit cards (Visa, Mastercard, American Express, Discover).

3.2 Credit Card Authorization for Reservations

To secure your reservation, we require credit or debit card information to be provided over the phone or through our secure online reservation system.

• By providing your card information, you authorize Austin Karaoke to charge your card for cancellation fees or no-show fees as described in Section 5 below.
• Your card will NOT be charged at the time of reservation for the cost of services; payment for services is collected in person as described in Section 3.1.

3.3 Card-Not-Present Transaction Fee

For any charges processed without the physical card present (including cancellation fees, no-show fees, or damage charges), a processing fee of 3% will be added to the total charge. This fee covers the increased processing costs associated with card-not-present transactions. This fee will be clearly itemized on your receipt.

3.4 Card Information Security

Austin Karaoke is committed to protecting your payment information. We comply with Payment Card Industry Data Security Standards (PCI DSS). We do not store your card verification code (CVV/CVC) after initial processing. Card information collected is used solely for the purposes described in these Terms and Conditions.

4. RESERVATION HOLDER RESPONSIBILITY

IMPORTANT: YOU ARE RESPONSIBLE FOR YOUR ENTIRE PARTY

4.1 Responsibility for Party Members

As the reservation holder, you assume full responsibility for the conduct, actions, and omissions of all members of your party, including but not limited to family members, friends, guests, and any other individuals who accompany you or use our services under your reservation. This responsibility applies whether or not you are physically present with the party member at the time of the conduct in question.

4.2 Liability for Party Member Actions

You agree to be liable for any and all damages, losses, costs, fees, or expenses incurred by Austin Karaoke as a result of the actions or omissions of any member of your party, including but not limited to:

1. Damage to Austin Karaoke property, equipment, or facilities;
2. Violations of these Terms and Conditions, including house rules and alcohol policies;
3. Disruptive, threatening, or illegal behavior that results in removal from the premises;
4. Injury to other customers, guests, or Austin Karaoke staff caused by a member of your party;
5. Any claims, lawsuits, or legal actions brought against Austin Karaoke arising from the conduct of your party members.

4.3 Indemnification for Party Member Conduct

You agree to indemnify, defend, and hold harmless Austin Karaoke from any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to the actions of any member of your party while on our premises or in connection with your reservation.

4.4 Duty to Supervise

You are expected to communicate these Terms and Conditions to all members of your party and to supervise and monitor their conduct to ensure compliance. Austin Karaoke reserves the right to hold you accountable for any violations, regardless of whether you were aware of the specific conduct at the time it occurred.

5. CANCELLATION AND NO-SHOW POLICY

PLEASE READ THIS SECTION CAREFULLY

5.1 Cancellation with Adequate Notice (48+ Hours)

If you cancel your reservation at least 48 hours or more before your scheduled reservation start time, no cancellation fee will be charged. To cancel, please contact us by phone at the number provided in your confirmation or by email.

5.2 Late Cancellation (Less Than 48 Hours)

If you cancel your reservation less than 48 hours before your scheduled reservation start time, you will be charged a cancellation fee ranging from 50% to 100% of the reservation cost, at Austin Karaoke's discretion based on the timing of cancellation and our ability to rebook the room, plus the applicable 3% card-not-present processing fee. This fee will be charged to the credit card on file.

5.3 No-Show Policy

If you fail to arrive for your reservation without prior notice ("no-show"), you will be charged a no-show fee ranging from 50% to 100% of the reservation cost, at Austin Karaoke's discretion, plus the applicable 3% card-not-present processing fee. A reservation will be considered a no-show if you do not arrive within 30 minutes of your scheduled reservation time and have not contacted us to reschedule or cancel.

5.4 Exceptions

We understand that genuine emergencies occur. In cases of documented medical emergencies, severe weather events, or other extraordinary circumstances, we may, at our sole discretion, waive or reduce cancellation or no-show fees. Such requests must be made in writing within 48 hours of the missed reservation.

6. CONDUCT AND HOUSE RULES

6.1 Expected Conduct

Customers and their guests are expected to behave in a respectful, lawful, and appropriate manner at all times while on our premises. Disruptive, abusive, threatening, or illegal behavior will not be tolerated.

6.2 Right to Refuse Service

Austin Karaoke reserves the right to refuse service, terminate reservations, and remove any customer or guest from the premises for violation of these Terms, house rules, or at management's discretion for safety or operational reasons. No refund will be provided in such circumstances.

6.3 Alcohol Policy

Austin Karaoke is a BYOB (Bring Your Own Beverage) establishment that does not sell or serve alcohol. If you choose to bring alcoholic beverages, you must comply with all terms set forth in Section 7 (BYOB Alcohol Policy) and all applicable Texas laws. Valid government-issued identification is required for any guest who brings or consumes alcohol. Austin Karaoke reserves the right to refuse entry to any individual who appears intoxicated or to remove any guest who violates our alcohol policies.

6.4 Prohibited Items and Activities

The following are prohibited on our premises: weapons of any kind; illegal substances; outside food or beverages (unless pre-approved); smoking, vaping, or use of tobacco products; and any activity that damages property or endangers others.

7. BRING YOUR OWN BEVERAGE (BYOB) ALCOHOL POLICY

7.1 BYOB Permitted

Austin Karaoke does not hold a Texas Alcoholic Beverage Commission (TABC) permit and does not sell, serve, or provide alcoholic beverages. However, guests who are of legal drinking age (21 years or older) are permitted to bring their own alcoholic beverages for personal consumption within their reserved private karaoke room.

7.2 Age Verification Required

All guests who bring or consume alcoholic beverages must be at least 21 years of age. Austin Karaoke reserves the right to request valid government-issued photo identification (such as a Texas driver's license, state ID, passport, or military ID) from any guest who appears to be under 30 years of age. Guests who cannot provide valid ID will not be permitted to bring or consume alcohol on the premises.

7.3 Prohibition on Providing Alcohol to Minors

You agree that you will not provide, share, or make alcoholic beverages available to any person under the age of 21 while on Austin Karaoke premises. Adults (21 and older) may be held civilly liable under Texas law for damages caused by the intoxication of a minor if they knowingly provided alcohol to the minor or allowed the minor to consume alcohol on premises they control.

7.4 Responsible Consumption

All guests are expected to consume alcohol responsibly. Public intoxication is illegal under Texas Penal Code Section 49.02. Austin Karaoke reserves the right to refuse entry or remove any guest who appears to be intoxicated to the point of being a danger to themselves or others. No refunds will be provided if service is terminated due to intoxication or alcohol-related misconduct.

7.5 Hours of Consumption

In accordance with Texas law, alcoholic beverages may not be consumed on our premises after the legal hours for public consumption. Alcohol consumption must cease by 12:15 a.m. Sunday through Friday, and 1:15 a.m. on Saturday (or 2:15 a.m. if extended hours are in effect in our jurisdiction). Austin Karaoke staff may require the removal of all alcoholic beverages from the premises after these hours.

7.6 BYOB Rules and Restrictions

The following rules apply to all alcoholic beverages brought onto our premises:

1. Alcoholic beverages must remain within your reserved private karaoke room at all times. Consumption of alcohol in common areas, hallways, restrooms, or the lobby is strictly prohibited.
2. Glass containers are permitted but must be handled carefully. You are responsible for any damage or injury caused by broken glass.
3. Austin Karaoke will not store, refrigerate, serve, pour, or handle your alcoholic beverages. Self-service only.
4. You are responsible for disposing of all empty containers and cleaning up any spills related to your beverages.
5. Any unused alcoholic beverages must be removed from the premises at the end of your reservation. Austin Karaoke is not responsible for any alcohol left behind.

7.7 Designated Driver and Safe Transportation

We strongly encourage all guests who consume alcohol to designate a sober driver or arrange for alternative transportation (taxi, rideshare, etc.) before leaving our premises. Austin Karaoke is not responsible for the actions of guests after they leave our premises, but we urge all guests to make safe and responsible choices.

7.8 Assumption of Risk and Liability

By bringing and consuming alcoholic beverages on our premises, you acknowledge and assume all risks associated with alcohol consumption. You agree to indemnify and hold harmless Austin Karaoke from any claims, damages, or liabilities arising from your consumption of alcohol or your provision of alcohol to others while on our premises, to the fullest extent permitted by Texas law.

8. PROPERTY AND DAMAGES

IMPORTANT: DAMAGE LIABILITY NOTICE

8.1 Customer Responsibility for Property

You are responsible for any damage to Austin Karaoke property caused by you or members of your party during your visit. This includes, but is not limited to, damage to karaoke equipment, microphones, speakers, screens, furniture, fixtures, walls, flooring, restrooms, and any other property belonging to Austin Karaoke.

8.2 Damage Assessment and Charges

In the event of damage, Austin Karaoke will assess the cost of repair or replacement. You agree to pay the full cost of repair or replacement of any damaged property. By providing your credit card information for your reservation, you authorize Austin Karaoke to charge your card for the cost of any damages, plus the applicable 3% card-not-present processing fee, within 30 days of the incident.

8.3 Documentation

We will provide you with documentation of any damage and associated charges via email or mail. You will have the opportunity to review and dispute charges within 10 business days of notification.

8.4 Additional Remedies

Austin Karaoke reserves the right to pursue additional legal remedies for damages that exceed the authorized card charge limit or for willful destruction of property.

9. ASSUMPTION OF RISK AND LIABILITY WAIVER

9.1 Acknowledgment of Risks

You acknowledge and understand that visiting and using the services at Austin Karaoke involves certain inherent risks. These risks include, but are not limited to: slips, trips, and falls; broken bones; sprains and strains; cuts and bruises; head, neck, or back injury; hearing damage or loss from loud music and audio equipment; injury from equipment (including microphones, cords, speakers, and other karaoke equipment); injury from interaction with other guests; allergic reactions; illness; emotional distress; and in extreme cases, paralysis or death. These injuries may result from your own actions, the actions of others, the condition of the premises, equipment malfunction, or other causes.

9.2 Voluntary Participation

You acknowledge that your participation in activities at Austin Karaoke is entirely voluntary. You are choosing to enter our premises and participate in our services with full knowledge of the inherent risks involved.

9.3 Release of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE AUSTIN KARAOKE, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION, INCLUDING BUT NOT LIMITED TO CLAIMS FOR NEGLIGENCE, PERSONAL INJURY, BODILY HARM, EMOTIONAL DISTRESS, WRONGFUL DEATH, AND PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY YOU OR YOUR PROPERTY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF AUSTIN KARAOKE OR OTHERWISE, WHILE PARTICIPATING IN ACTIVITIES AT OR USING THE SERVICES OF AUSTIN KARAOKE.

Notice Regarding Minors: Under Texas law, a parent or legal guardian cannot waive a minor child's personal injury claims. This release applies to the adult signing these Terms and to any derivative claims (such as loss of consortium), but does not extinguish a minor's independent right to pursue personal injury claims.

9.4 Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS AUSTIN KARAOKE, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND COURT COSTS) ARISING OUT OF OR RELATED TO: (A) YOUR USE OF AUSTIN KARAOKE'S PREMISES OR SERVICES; (B) THE ACTIONS OR OMISSIONS OF YOU OR ANY MEMBERS OF YOUR PARTY; (C) YOUR BREACH OF THESE TERMS AND CONDITIONS; OR (D) ANY INJURY OR DAMAGE TO THIRD PARTIES CAUSED BY YOU OR MEMBERS OF YOUR PARTY, EVEN IF SUCH CLAIMS ARE CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF AUSTIN KARAOKE. THIS INDEMNIFICATION OBLIGATION SHALL SURVIVE THE TERMINATION OF THESE TERMS AND CONDITIONS.

9.5 Limitations

This release does not apply to claims arising from gross negligence, willful misconduct, or intentional acts by Austin Karaoke. Nothing in these Terms is intended to release Austin Karaoke from liability that cannot be released as a matter of Texas law.

10. PERSONAL PROPERTY

Austin Karaoke is not responsible for any loss, theft, or damage to personal property brought onto our premises. Customers are responsible for safeguarding their personal belongings at all times. We recommend leaving valuables at home or secured in your vehicle.

11. PHOTOGRAPHY AND RECORDING

11.1 Customer Recordings

You may take photographs and videos for personal, non-commercial use within your private karaoke room. Recording in common areas or of other customers without their consent is prohibited.

11.2 Austin Karaoke Recordings

By entering our premises, you consent to being photographed, filmed, or recorded by Austin Karaoke for security, promotional, or operational purposes. If you do not wish to appear in promotional materials, please notify management.

11.3 VIDEO AND AUDIO SURVEILLANCE

For the safety and security of our customers, staff, and property, Austin Karaoke employs a video and audio surveillance system. By entering our premises, you acknowledge and consent to being recorded by video and audio monitoring equipment located in common areas, hallways, lobbies, and points of entry/exit.

12. INTELLECTUAL PROPERTY

All karaoke content, including music tracks and videos, is licensed for on-premises use only. Copying, recording, distributing, or publicly sharing copyrighted karaoke content is strictly prohibited and may constitute copyright infringement.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUSTIN KARAOKE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES OR PREMISES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO AUSTIN KARAOKE FOR YOUR RESERVATION. IN NO EVENT SHALL AUSTIN KARAOKE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

14.2 Venue

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas. You consent to the jurisdiction of such courts.

14.3 Informal Resolution

Before initiating any formal legal action, you agree to first contact Austin Karaoke to attempt informal resolution of any dispute. We are committed to addressing your concerns fairly and promptly.

15. GENERAL PROVISIONS

15.1 Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Austin Karaoke regarding your use of our services and supersede any prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15.3 Waiver

The failure of Austin Karaoke to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Modifications

Austin Karaoke reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website or providing notice to you. Your continued use of our services after any modification constitutes acceptance of the modified Terms.

15.5 Assignment

You may not assign or transfer these Terms or your rights hereunder without the prior written consent of Austin Karaoke. Austin Karaoke may assign these Terms without restriction.
